This page tells you information about us (“Pennyroyal Sports Pty Ltd”) and the legal terms and conditions (the “Terms”) on which we sell any of the products (the “Products”) listed on our website (“our site”) to you (the “Consumer” and/or “Customer”).
These Terms will apply for the sale of all Products to you as a consumer. Please read these Terms and Conditions carefully and make sure that you understand them, before ordering any Products from our site. Please note that by ordering any of our Products, you agree to be bound by these Terms and the other documents expressly referred to in it.
For the purposes of clarity, when used in this document, depending on the context, “we,” “our”, “us” and “Pennyroyal Sports” refers to Pennyroyal Sports Pty Ltd, who is an online retail business for premium sporting and lifestyle apparel brands.
We amend these Terms and Conditions from time to time. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 26th February 2023.
1. About Us
1.1 We operate our site (website) www.pennyroyalsports.com.au. We are Pennyroyal Sports Pty Ltd, a company registered in Victoria, Australia. Our postal address is PO Box 3015, Shandeen LPO, Geelong West, Victoria, 3218. Our ABN number is 16 658 496 309.

2. Our Products
2.1 The images of the Products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflects the colour of the Products. Your Products may vary from those images.
2.2 Although we have made every effort to be as accurate as possible, some products may have variances on the published details. If this matters to you please obtain confirmation before placing an order.
2.3 The content of our website is subject to change without notice and is for your general information and use only.
2.4 The packaging of the Products may vary from that shown on images on our site.
2.5 All Products shown on our site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will not confirm your order.
2.6 All prices displayed on our site are in Australian dollars (AUD)
2.7 As with images and information, prices of the Product(s) on our site may vary. We take all reasonable care to ensure that the prices of Product(s) are correct at the time when the relevant information was entered onto the system.
2.8 Prices for our Products may change from time to time, but changes will not affect any order which we have confirmed with a ‘Order Confirmed’ email indicating we have picked and packed your order and its on its way to Australia Post.
3. Personal Information
3.1 In the performance of our obligations in selling a Product to you, we will need to collect and process your personal data. We only use your personal information in accordance our Privacy Policy, which is available on our website. Please take the time to read these, as they include important terms which apply to you.
3.2 We will share your financial details with our bank and processing agents in order to process payments only. We must of course share your address information with our courier companies, which may include telephone/mobile numbers and e-mail addresses.
4. Product Orders
4.1 Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.
4.2 After you place an order, you will receive an e-mail from us acknowledging that we have processed your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will only take place as described in clause 4.3.
4.3 We will confirm our acceptance of your order by sending you an e-mail confirming your order, in an email titled “Order Confirmed”. You will also receive a subsequent email also indicating how you can track your order in an email from Australia Post titled “Your delivery is on its way”.
4.4 If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because of an error in the price on our site, we will inform you of this by e-mail, and you will not receive an ‘Order Confirmed’ email. If you have already paid for the Products, we will refund you the full amount as soon as possible unless you wish to continue with an amended order.
5. Refunds
5.1 In line with our customer experience value proposition and our guiding principles, we have a no questions asked returns policy. However, to be eligible for a refund, you must return the Products adhering to the following requirements;
- The Products must be returned within 28 days of the delivery date
- The Products must be un-worn, unwashed and in the same condition as it arrived
- The Products must have all original tags still attached
- The Products must be returned in original packaging
- The Products must be returned with a copy of the “Order Confirmed” email.
5.2 All returning Products are to be sent to the following address, within a secure package:

5.3 If you have returned the Products because they were faulty, we will refund the price of a faulty Product in full, and any applicable delivery charges incurred (standard rates) in returning the Products to us.
5.4 Unless the Products are returned to us under clause 5.3 above, you will be responsible for the delivery charges incurred in returning the Products to us.
5.5 It is at our sole discretion as to what is deemed faulty and what is a reasonable amount of time should a product be returned as faulty.
5.6 We will provide a full refund of the price you paid for the product within 14 days of receiving a returned items which has met the requirements outlined within clause 5.1 or if we are satisfied the Product was faulty (5.3 and 5.5) and it was returned to us.
5.7 We will refund you on the credit card or debit card used by you to pay for the Products originally.
5.8 You have a legal obligation to take reasonable care of the Products while they are in your possession.
6. Exchanges
6.1 We will not accept exchanges for Products purchased from our site.
7. Delivery
7.1 Your order will be picked and packed and sent by Express Post the next business day from when the order was placed and the “Order Processed” email is sent. You will notified when picking and packing has been completed via the “Order Confirmed” email, which will be followed shortly after by a “Your delivery is on its way” email from Australia Post which occurs when the order is registered with Australia Post. This email will also have package tracking details and further delivery information. This process will occur unless there is an Event Outside Our Control (see clause 10). If we are unable to complete this process and therefore the package delivery timeframe because of an Event Outside Our Control, we will aim to contact you with a revised estimated delivery date.
7.2 Delivery will be completed when we deliver the Products to the address you gave us.
7.3 As described in 7.1, all product orders are confirmed (picked and packed) the next business day from when the order is placed and the “Order Processed” email is sent. Products are sent ‘Express Post’, and you will be notified via the “Order Confirmed” email and the “Your delivery is on its way” email when this occurs. Business day refers to Monday to Friday, excluding public holidays held in Victoria, Australia.
7.4 All orders will be provided with free ‘Express Post’ delivery Australia wide via Australia Post.
7.5 The “Your delivery is on its way” email will also contain relevant tracking and delivery information.
7.6 The Products will be your responsibility from when they are delivered to you or you collect them.
8. Payment
8.1 You can only pay for Products using methods outlined on our website. Payment for the Products and any applicable delivery charges is immediate.
9. Re-sale
9.1 You agree not to use the Product for any commercial venture, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
10. Events outside our control
10.1 We will not be liable or responsible for any delay in delivery leading to failure to perform, or delay in performance of, any of our obligations under a sale that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause 10.2.
10.2 An “Event Outside Our Control” means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
10.3 If an Event Outside Our Control takes place that affects the performance of our obligations we will contact you as soon as reasonable possible to notify you.
11. Communication

11.2 If we have to contact you, we will do so by e-mail, mobile or by ‘Express Post’ to the address you provide to us in your order.
11.3 As a Pennyroyal Sports customer and in line with our Privacy Policy, you may receive Pennyroyal Sports promotional information and material, including sales, offers and discount codes from time to time via your valid email address. You will maintain an ‘opt out’ option at any time to remove your registered email from the distribution list.
11.4 Via our general customer emails, or on our website we may from time to time include stories, images or links to other organisations or to information which is provided by others. These inclusions do in no way signify our endorsement of these organisations or the content contained within these stories, images or website links
11.5 Our site uses cookies to monitor browsing preferences, and improve the user experience.
11.6 Use of information, images, logos and designs displayed on our website or customer emails are not to be reproduced within any medium by any organisation or individual without the written prior consent of us.
12.1 We may revise these Terms and Conditions from time to time, including without limitation in the following circumstances:
- payment terms and changes in how we accept payments from you; and
- changes in relevant laws and regulatory requirements.
12.2 Every time you order Products from us, the Term and Conditions in force at that time will apply between you and us.
12.3 Whenever we revise these Terms in accordance with this clause 14, we will keep you informed by stating when these Terms have been amended and the relevant date at the top of this page.
13. Other important terms
13.1 We may transfer our rights and obligations in relation to the sale of a Product to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you emailing you as soon as possible.
13.2 You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
13.3 Any dispute arising out of the use of our site or a product order is subject to the Laws of Victoria, Australia.
